1. Service description
DBOT ("the Service") is a desktop software application that executes automated trades on leveraged exchange-traded funds (ETFs) using your own brokerage account. The Service runs locally on your computer and communicates with your broker (currently Alpaca or Robinhood) using credentials you provide. The DBOT website (d-bot.net) provides account management and subscription billing.
2. NOT investment advice
DBOT is software, not an investment adviser, broker-dealer, or registered investment company. We do not provide individualized investment advice. Any trading decisions made by the bot are based on automated rules you configure. You are solely responsible for all trades placed under your account.
3. Risk acknowledgment
Trading leveraged ETFs involves substantial risk and is not suitable for all investors. Leveraged and inverse ETFs are designed for short-term holds and decay over time due to daily rebalancing. You may lose all of the money you put at risk, and potentially more if you trade on margin. Past performance shown in any backtest, simulation, or marketing material does NOT guarantee future results. By using DBOT, you acknowledge these risks and agree to assume them entirely.
4. Eligibility
You must be at least 18 years old and legally permitted to open and use a brokerage account in your jurisdiction. You are responsible for complying with all applicable laws, including tax reporting on any gains or losses.
5. Subscription & billing
The Pro tier is billed monthly through Stripe. Charges recur automatically on the same day of each month until cancelled. You may cancel at any time from your account dashboard; access continues until the end of the paid period. Subscription fees are non-refundable except as described in our refund policy (Section 6).
6. Refund policy
If you cancel within 7 days of your initial Pro subscription purchase, contact us and we will refund that first payment in full. After 7 days, no refunds are issued for partial-month or unused time. Cancellation stops future billing immediately.
7. Acceptable use
You will not: redistribute or resell the software; reverse engineer the desktop application; use the Service for unlawful purposes; circumvent the tier system or share your API key with others; use the Service to manipulate markets or violate brokerage rules. Violations may result in termination without refund.
8. Limitation of liability
To the maximum extent permitted by law, DBOT and its operators are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to trading losses, missed trades, broker outages, software bugs, or data inaccuracies. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
9. No warranty
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or profitable. We do not guarantee any specific trading results.
10. Account termination
We may suspend or terminate your account if you violate these Terms, attempt to defraud us or other users, or engage in activity that puts the Service at risk. You may terminate your account at any time from the dashboard.
11. Changes to these terms
We may update these Terms periodically. Material changes will be communicated via email to your account address. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
12. Governing law
These Terms are governed by the laws of the United States and the state in which the operator is based. Any dispute will be resolved in the courts of that jurisdiction.
